These terms and conditions apply when using the MOONAPARTMENTS.RO website accessible at www.moonapartments.ro.

This document entitled “Terms & Conditions” represents a binding legal agreement between you as a Client/User/Guest and MoonApartments, regarding the use of the site, the reservation of properties and/or the purchase of services made through moonapartments.ro. The acceptance of these terms & conditions is mandatory before placing an order / booking.

MoonApartments.ro is a project that aims to bring online modern & welcoming short term rentals in Cluj Napoca.

TERMS DEFINITION

These terms specifically relate to the following services that may be purchased or accessed through our website:

PROPERTY

The term “property” refers to any accommodation unit available for rent on the moonapartments.ro website

OWNER

The term “owner” refers to the company who manages the MOON Apartments properties.

SERVICES

The term “services” or “service” refers to any service purchased on the moonapartments.ro website and includes services such as – transportation from / to the airport, crib rental, etc.

The services offered by moonpartments.ro are optional and have a separate cost, not included in the reservation of a property. Their price is specified for each service separately on the dedicated page.

BOOKING/RESERVATION

The term “reservation” or ”booking” refers to the action of making a reservation on the moonapartments.ro website and represents the rental of a property available on the website, between the selected dates.

GUEST

The term “guest” refers to the person who makes a reservation of a property on the moonapartments.ro website and is the beneficiary of this reservation.

BOOKING A PROPERTY AND PURCHASING SERVICES

PRICES

All payments on moonapartments.ro will be made in RON.

The prices are displayed according to the BNR exchange rate for RON – equivalent in EUR / USD and include VAT according to the current legislation.

Prices may differ depending on the period, special events, etc. We reserve the right to change the price on the website without notice.

There are no additional fees when paying for a reservation made on moonapartments.ro.

Sometimes, despite our best efforts, the displayed price may be lower than the correct price. If this happens, we will contact you to inform you of the situation and give you the option to make a payment for the correct price or refund if you do not wish to proceed with the purchase.

BOOKING a PROPERTY

When you book a property on moonapartments.ro and click the “I understand and accept the Terms and Conditions” box, you agree to these terms and conditions and our privacy policy. Do not proceed to complete your booking until you have read, understood and accepted these terms and conditions.

Only people over the age of 18 can make a reservation on moonapartments.ro

To book a property follow the next steps:

  • Select the timeframe for which you wish to nook the property
    • Check-in date – the date when you will arrive at the property
    • Check-out date- the date when you will leave the property
  • Select the property you wish to book and click on ”Book”
  • In order to send the reservation the Guest must provide all the neccesary data (such as name, surname, address, phone number, email, etc)
  • In order to complete the reservation the Guest must slect the payment method, make the payment and accept the current terms & conditions.
  • You will receive an email on the provided address with your booking details.
  • After placing the booking, our team will review and confirm it within 24 hours (on working days).

PURCHASING OPTIONAL/ADDITIONAL SERVICES

On the booking confirmation page, you can also select additional services to benefit from during your stay at Moon Apartments.

Select the desired service and pay for it.

PAYMENT POLICY

Any booking made on MoonApartments.ro’s website must be paid in full at the time of booking.

Payment for bookings and services purchased on moonapartments.ro can be made in the following ways:

Online with a debit card through our partnet NETOPIA PAYMENTS.

No additional transaction fees are charged.

Regardless of the currency you have in your account, transactions are made in RON, at the exchange rate of your bank.

CANCELLATION POLICY

If you made a booking of a property on moonapartments.ro and for any reason you want to cancel it, you can request its cancellation, with the following conditions:

If the cancellation is made 3 days before arrival or earlier: the reservation value will be refunded in full.

If the cancellation is made later (1 or 2 days before the arrival date): 50% of the reservation value will be refunded.

Refunds can only be requested by the person who made the reservation.

How to request a booking cancellation:

If you want to cancel your booking on moonapartments.ro please follow the next steps:

Send an email to moonaparts@gmail.com with the following information:

  • Subject: Booking Cancellation
  • Content:
    • The name of the guest who booked the property
    • Booking info: booking number, booked property, time (check-in & check-out dates)
    • Bank account – the account where you want to receive the value of the booking.

After we have analyzed your request, we will confirm your cancellation and refund the value of the reservation according to the conditions mentioned above.

CHECK IN POLICY

At Moon Apartments we do check-in differently – easy and fast – online.

After receiving the confirmation email for the booking made on moonapartments.ro, you will receive an email dedicated to the check-in process.

THE CHECK IN PROCESS

Since our properties do not have a physical reception, please check in online in advance. This step is not optional – it is mandatory to check-in online to receive access information to the reserved property.

STEP 1– VERYFING YOUR INFORMATION

This step involves filling in and verifying guests – name, address, phone number and email.

STEP 2 – ACCEPTING AND SIGNING THE RENTAL AGREEMENT

You will be able to read and sign online the rental contract for the booked property. No worries, you’ll sign easily online.

STEP 3 – LOAD AN IMAGE OF YOUR ID AND TAKE A SELFIE

We want to make sure that the guest booking the property is the same on paper as in reality – so verifying your biometrics is a safety necessity.

Good to know:

The verification of this information will be carried out through the third-party platform CHECKEDIN, a secure platform specialized in verifying and protecting your identity.

On average you need 5 minutes to complete the check-in process.

We do not store or use your data for any other means that those neccesary to complete your booking and verification process.

If you do not complete the check-in process before arrival we reserve the right to cancel your booking.

RENTING A PROPERTY AND HOUSE RULES

To benefit from booking at a MOON APARTMENTS property you must read and agree to the temporary rental agreement and respect the house rules.

The temporary rental agreement contains the following information, articles and clauses:

  • ID data for Guests & Owner – name, address, id data, contact info;
  • Details of the booked property – description, address, layout, ammenities, utilities.
  • Rental dates: date & time for check-in & check-out selected for the booking
  • Obligații Rights, Limitations and Obligations

This contract must be completed and signed during the online check-in process. If this step is not performed, we reserve the right to cancel your reservation.

HOUSE RULES

While you enjoy your stay at Moon Apartments please make sure to follow our house rules:

  • Smoking:  This apartment is non-smoking, please respect this instruction;
  • Good neighbourhood: Please respect the neighbourhood and avoid making noise after 10 p.m.
  • Pets: There are no pets allowed in this apartment.
  • Party: This accommodation does not allow parties – please enjoy your stay without the extra noise.
  • Visitors: Extra or nonregistered visitors are not allowed in the apartment. This accommodation is best suited for 2 people, please respect this limit.
  • Hours: Respect the check in/out hours: check in starting at 14:00 (2 pm), check out until 11:00 (11 am)

Before your departure:

To facilitate the reception of the following guests and responsible consumption, before departure please:

  • Clean your dishes
  • Empty the bins & take the trash out;
  • Turn off the lights;
  • Make sure all the appliances are turned off
  • Turn off the AC / turn off the heat
  • Close the windows and door;
  • Put the keys back in the key box.
  • Send us a picture of the keys in the box.

Note:

*For bookings that are over 5 nights, there is a free mandatory cleaning session included (eta. ~ 2 hours). The day & time interval for the cleaning session will be established per your convenience.

PROPERTY ACCESS

Access to the booked property is allowed only during the period specified in your reservation, as follows:

(Selected check-in date), starting with 14:00 (2 PM)

(Selected check-ou date), untill 11: 00 (11 AM)

Accessing the apartment: SELF CHECK IN available

At any time after the designated check-in time, you have easy access to the apartment using the secure key box. You will receive the code and all instructions on the day of arrival at Moon Apartments – via text message to the phone number entered at the time of booking.

PRIVACY & COOKIES POLICY

Please ensure that you read, understand and accept our Privacy and Cookie Policy which governs your use of the moonapartments services as part of our Terms and Conditions.

The text and illustrations (including photos) used on moonapartments.ro are protected by copyright and may not be copied in whole or in part without the express permission of moonapartments.ro

We would like to know your feedback regarding the reservations you purchased through moonapartments.ro

By submitting content to us, you understand and agree that:

All submitted content is subject to these terms of use. In the event of a conflict between these terms and our Privacy Policy, these terms will prevail;

For any content you submit, you grant moonapartments.ro the right to use, copy, modify or publish, translate and distribute the content in any form or medium without compensating you;

RIGHTS AND OBLIGATIONS

GUEST’s RIGHTS AND OBLIGATIONS

  • The guest has the right to access the booked property during the period specified in the booking.
  • The guest has the right to use the reserved property for residential purposes only.
  • The guest has the right to use the ammenities, equipment and facilities of the property during the stay.
  • The Guest has the obligation to notify the Owner if there are problems or non-functional equipment at the time of checking-in at the Property. Otherwise, he will be responsible for their defective condition upon handing over the Property.
  • The Guest must allow the OWNER access to the property for repair, inspection, cleaning or emergency purposes. The OWNER will exercise this right of access in a reasonable manner, giving at least 2 hours notice (except in case of emergency).
  • The guest has the obligation to respect the check-in and check-out times mentioned in the reservation.
  • The guest has the obligation to respect the maximum capacity of people specific to each PROPERTY.
  • The Guest is not entitled to sublet the reserved Property. Failure to comply with this rule will result in the immediate termination of this agreement and an additional fee of 5000 RON.
  • The Guest will use the Property for residential use only and is not authorized to sell products or services on the Property or conduct commercial activities.
  •  The Guest will use the Property only for lawful purposes. Any other use including, but not limited to: drug use, verbal or physical abuse of a person, or illegal sexual behavior will result in immediate termination of contract – immediate vacation – without refund of advance payments.

OWNER’s RIGHTS AND OBLIGATIONS

  • The Owner reserves the right to terminate the Guest’s reservation in cases such as, but not limited to:
    • If there are more guests at the property than the authorized number
    • If there are complaints or evidence that the property is being used for purposes other than residential
    • If there are parties in the apartment
    • If the house rules are broken.
  • If the reserved Property becomes unavailable for reasons beyond the control of the Owner – such as technical malfunctions or other unforeseeable situations, the Owner will try to offer a similar accommodation option. If this is not possible, or the Guest does not accept the proposed option, 100% of the value of the reservation will be returned to the Guest.

DAMAGES AND TAXES

The GUEST must keep the PROPERTY in good condition, clean and ready for rent and use the PROPERTY only in a careful and lawful manner. At the end of the rental period, the GUEST will leave the PROPERTY in a good rental condition, in accordance with what is defined by the OWNER as optimal conditions for the next GUEST – that is, in the condition that he found when accessing the property.

TAXES FOR POSSIBLE DAMAGES

If the GUEST causes damage to the PROPERTY, furniture or appliances, the GUEST undertakes to pay the OWNER the value of the damaged goods, as assessed by the OWNER.

OTHER TAXES:

The ”Delayed Leave” TAX

Failure to comply with the check-out time may result in the charging of additional fees set at 300 RON, unless this aspect is negotiated before the end of the property.

The ”Party Damage” TAX

Parties are not allowed within the Moon Apartments properties, and failure to comply with this rule may result in additional fees of 500 RON.

The ”Deep Cleaning” TAX

If the property is in an extremely dirty state at the time of check-out, a cleaning fee of 400 RON will be charged.

*this stage refers to unusual situations after using a property – such as – dirty walls, smell of cigarettes or smoke alarms going off, stains that cannot be cleaned, etc.

Moonapartments.ro does not charge a deposit fee when making the reservation, but in case of damage or violation of the rules mentioned above, you will receive a payment summons to recover the damages.

LIABILITY AND LIMITATIONS

POSESSIONS

Personal items or goods left on the Property are not the responsibility of the OWNER. The OWNER will make all reasonable efforts to return the Guest’s belongings, but is not responsible for any items left behind.

LIABILITY

The Guest indemnifies and holds harmless the OWNER from any allegation of personal injury, property damage or loss arising out of the use of the PROPERTY, regardless of the nature of the accident, injury or loss. The GUEST expressly acknowledges that any property damage insurance that the OWNER may request does not cover what falls into the GUEST’s private property.

DISPUTES AND APPLICABLE LAW

The properties available on moonapartments.ro are located in Romania, therefore they are limited and subject to the Romanian law.

If you have a problem with our services, we recommend that you talk to us about it. If it really cannot be resolved through discussion, the misunderstandings will be resolved through arbitration or will be submitted for resolution to the competent courts in Cluj-Napoca.

We also inform you that, if you consider it necessary, you have the possibility to use the SOL (online dispute resolution) platform, present in the website interface, or to file a complaint addressed to ANPC in order to remedy any discrepancies or problems.
